President of the European Patent Office, Benoît Battistelli, recently reiterated in a meeting with delegates from the UK’s Chartered Institute of Patent Attorneys (CIPA) that
“Brexit will have no impact on UK membership of the EPO”
Battistelli went on to confirm that because the EPO is an independent international organisation (of which the UK is a founding member) and not an EU agency, Brexit will have no consequence on UK membership of the European Patent Organisation.
Brexit will also have no effect on European patents which have been, or will be, validated in the UK and European patent attorneys based in the UK will continue to be able to represent applicants before the EPO.
The EPO chose to issue this announcement to quash any rumours which may have been circulating to the contrary.
